Conditions of Use of Agent Gramik App. Please read these conditions carefully before using the Agent Gramik website or mobile application. By using the Gramik website or Gramik mobile application (“Platform”), you signify your agreement to be bound by these conditions (“Conditions of Use”). In addition, when you use any current or future Gramik service (Eg. Agent Gramik Marketplace) (Gramik Service), you will also be subject to the terms, guidelines and conditions applicable to that Gramik Service (Terms). If these Conditions of Use are inconsistent with such Terms, the Terms will prevail. These Conditions of Use constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures. For the purpose of these Conditions of Use, wherever the context so requires the term “you”, “your”, “user” or “customer” shall mean any natural or legal person who uses the Platform and the term “Gramik”, “we”, “us” or “our” shall mean Gramik Agriprojunction ventures private limited. 1. Your Account If you use the Platform, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided to us through Platform. You agree and acknowledge that you are not a ‘consumer’ as defined under the Consumer Protection Act, 2019 and will use your account on the Platform to purchase products and services for your business purposes and not for your personal use. Gramik reserves the right to refuse access to the Platform, terminate accounts, remove or edit content at any time without notice to you. 2. Privacy
Please review our Privacy Notice, which also governs your visit to Gramik, to understand our practices. The personal information / data provided to us by you during the course of usage of Gramik will be treated as strictly confidential and in accordance with the applicable laws and regulations. If you object to your information being transferred or used, please do not use the Platform. The data collected by us may be used to offer / improve our services and features and the same will be treated as strictly confidential and in accordance with the applicable laws and regulations. 3. E-platform for communication You agree, understand and acknowledge that the Platform is an online marketplace platform that enables you to purchase products and services listed on the website at the price indicated therein at any time from any location. You confirm that any purchase you do from the Platform is out of your own choice and free will. From time-to-time Agriprojunction Ventures Private Limited (“Gramik”) may recommend/broadcast certain product and services for sale at its Platform. Sometimes these recommendations may be specific to you based on certain algorithm that we may use. You acknowledge that the purchase of any such product and services on the Platform is exclusively your choice. By using the Platform, you expressly agree to be bound by the Terms. If you do not agree with any of the Terms, please do not use the Platform. If you have any questions about the terms, please contact at sales@gramik.in 4. Pricing All the products and services listed on the Platform will be sold at the price specified therefor. The prices of such products and services mentioned at the time of ordering will be the prices charged. You acknowledge and understand that prices are provided directly by sellers on Agent Gramik, and Gramik has no control or command over pricing which may vary from batch to batch for various products. You further acknowledge that the price displayed is the final price and is not subject to negotiations.You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from the Platform and you agree to bear any and all applicable taxes including but not limited to GST, duties, cess etc.
We will not be responsible for delay in delivery of product or services booked through the Platform due to unforeseen rain, unavailability of operators / machines, natural calamity, governmental actions, lockdowns, epidemic, labour availability or any other unforeseeable reason beyond our control. In the event that happens, we will, at our option, either make commercial efforts to reschedule the delivery of such products and services to a date nearer to the earlier committed date or cancel and refund the amount that you paid, with notification to you. 5. Cancellation, Returns and Refunds of Orders Once you have placed an order, it cannot be cancelled by you. Any cancellation would be at the sole discretion of Gramik subject to applicability of cancellation fees. If you request cancellation before pre-invoicing of order, Gramik will charge 2% of the invoice value as cancellation fee when processing the refund to you. This will be applicable w.e.f. 1st April 2024. The order may be refused to be accepted only if there is a delay in delivery date mentioned on the app, any material damage, supply of incorrect products. If you request cancellation post-invoicing of order or If you refuse to accept delivery of the products due to any reason other than the above mentioned reasons, Gramik will charge 5% of the invoice value as cancellation fee when processing the refund to you. In case of multiple attempts (more than 2) by the transporter to deliver the products and inability to deliver the material will also lead to order cancellation and deduction of 5% invoice value when processing the refund to you. Once you have received an order, it cannot be returned by you. Any return would be at the sole discretion of Gramik. In case of any damage or issue with the product, you agree and acknowledge that your sole remedy would be a replacement of such damaged product as per the terms and conditions communicated by Gramik from time to time. In the event a replacement is not feasible, Gramik, at its sole discretion, may issue a refund. The refund may be full or partial, at Gramik’s sole discretion. 6. Advisories and other related services
We may from time to time provide farm related advisories to you to improve farm productivity and efficiency and also crop advisory services. You agree that these advisories are generic in nature and may not take into account your specific requirement. In the event you choose to follow the advisory, you agree that it is out of your choice and freewill. Gramik will not be liable for any losses or damages that may arise on following such advisory. You shall use your own judgment in following such advisory. 7. Sale of third party products and services We facilitate sale and purchase of third party products and services on the Platform including those from insurance companies. You understand that we are only acting as facilitators for the sale of such product and services and therefore we cannot be made liable for any claim that you may have against such third party seller. In the event you have such claim, you agree that you will pursue such claims directly with the seller of such product and services and not involve us in anyway. The assurance of product quality, etc. will be of the particular third party seller only and Gramik will not be liable for the same. 8. Access to Platform We will do our utmost to ensure that availability of the Platform is uninterrupted and that transmissions are error-free. However, due to the nature of the Internet, this cannot be guaranteed. Gramik makes no warranties as to the availability of completely secure, or virus free services as the platform is dependent on third party service providers. Also, your access to the Platform may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. Additionally, Gramik shall not be liable for any delay, loss of data/information or other failure of performance during the scheduled downtime that is beyond the control of Gramik. 9. Licence for Platform access Subject to your compliance with these Conditions of Use and payment of applicable fees, if any, Gramik grants you limited license to access and make personal use of the Platform, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Gramik and / or its affiliates, as may be applicable. This licence does not include any resale or commercial use of the Platform or its contents; any collection and use of any product or service listings,
descriptions, or prices; any derivative use of this Platform or its contents; any downloading or copying of account information for the benefit of another seller; or any use of data mining, robots, or similar data gathering and extraction tools. This Platform or any portion of this Platform (including but not limited to any copyrighted material, trademarks, or other proprietary information) may not be reproduced, duplicated, copied, sold, resold, visited, distributed or otherwise exploited for any commercial purpose without express written consent of Gramik and / or its affiliates, as may be applicable. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Gramik and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilising Gramik's or its affiliates' names or trademarks without the express written consent of Gramik and / or its affiliates, as applicable. Any unauthorised use terminates the permission or license granted by Gramik and / or its affiliates, as applicable. 10. Your Conduct You must not use the Platform in any way that causes, or is likely to cause, the Platform or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not Gramik, are responsible for all electronic communications and content sent from your computer to us and you must use the Platform for lawful purposes only. In case there is any software bug or technical glitch (“Software Error”), you shall inform Gramik at the earliest and will not make any unlawful or fraudulent gains because of such Software Error. Gramik will have the right at all times to take such actions as may be required against you for such unlawful and fraudulent gains including clawback, blocking your account, termination Terms with you (if any), adjusting such gains against any previous dues, legal actions. You must not use the Platform for any of the following:
• for fraudulent purposes, or in connection with a criminal offense or other unlawful activity;
• to host, display, upload, modify, publish, transmit, store, update or share any information that does not belong to you and to which you have no right; or is violative of any law for the time being in force, offensive, deceptive, , abusive, indecent, insulting or harassing (including on the
basis of gender), blasphemous, defamatory, libellous, obscene, pornographic, paedophilic or menacing; racially or ethnically objectionable, disparaging or in breach of patent, copyright, trademark, confidentiality or any other proprietary information or right; or is otherwise injurious to third parties; or relates to or promotes money laundering or gambling; or is harmful to minors in any way; or impersonates another person; or threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting other nations; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses (or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource), political campaigning, commercial solicitation, chain letters, mass mailings or any spam”; or is invasive of another’s privacy, including bodily privacy; or deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact; or is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person; or
• to cause annoyance, inconvenience or any nuisance. Gramik, in its sole judgement, reserves the right (but not the obligation) to immediately terminate your access to the Platform in case of any violation of these Conditions of Use. Gramik also reserves the right (but not the obligation) to remove information or content from the Platform that, in its sole judgement, violates these Conditions of Use. 11. Reviews, comments, communications and other content Users of this Platform may post reviews, comments and other content; send communication; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not in violation of Section 10 of these Conditions of Use. If you do post content or submit material, and unless we indicate otherwise, you
a. grant Gramik and its affiliates a non-exclusive, royalty-free, irrevocable, perpetual and fully sublicensable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and
b. Gramik and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. You agree to perform all further acts necessary to perfect any of the above rights granted by you to Gramik, including the execution of deeds and documents, at its request. You represent and warrant that you own or otherwise control all of the rights to the content that you post or that you otherwise provide on or through the Platform; that, as at the date that the content or material is submitted to Gramik: (i) the content and material is accurate; (ii) use of the content and material you supply does not breach any applicable Gramik policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory); (iii) the content is lawful. You agree to indemnify Gramik and its affiliates for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these warranties. 12. Claims against Objectionable Content Because Gramik lists thousands of products and services for sale on the Platform and hosts many thousands of comments, it is not possible for us to be aware of the contents of each product or services listed for sale, or each comment or review that is displayed. Accordingly, Gramik operates on a "notice and takedown" basis. If you believe that any content on the Platform is illegal or in violation of Section 10 of these Conditions of Use (Objectionable Content), please notify our Grievance Officer immediately in writing or email. Once done, our Grievance Officer will acknowledge your complaint to remove such Objectionable Content, within 24 hours and come to a decision within 15 days. 13. Copyright, authors' rights and database rights All content included on the Platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Gramik, its affiliates or its content suppliers and is protected by India and international copyright, authors' rights and database right laws. The compilation of all content on this Platform is the exclusive property of Gramik and its affiliates and is protected by laws of India and international copyright and database right laws. All software used on this Platform is the property of Gramik, its affiliates or its software suppliers and is protected by India and international copyright and author' rights laws. You cannot systematically extract/ or re-utilise parts of the contents of the Platform without Gramik and / or its affiliates (as may be applicable) express written consent. In particular, you may not utilise any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Platform, without Gramik and / or its affiliates (as may be applicable) express written consent. You may also not create and/ or publish your own database that features substantial (eg: prices and product listings) parts of this Platform without Gramik and / or its affiliates (as may be applicable) express written consent. 14. Trademarks GRAMIK and other marks indicated on our Platform are trademarks or registered trademarks of Agriprojunction Ventures Private Limited its affiliates, as applicable. Gramik’s graphics, logos, page headers, button icons, scripts and service names are the trademarks or trade dress of Gramik or its affiliates. Gramik's trademarks and trade dress may not be used in connection with any product or service that is not Gramik's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Gramik. All other trademarks not owned by Gramik that appear on this Platform are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Gramik. 15. Disclaimer You acknowledge and undertake that you are accessing the services on the Platform and transacting at your own risk and are using your best and prudent judgment before entering into any transactions through the Platform. You further acknowledge and undertake that you are not a ‘consumer’ as defined by the Consumer Protection
Act, 2019, and will use the Platform to order products and services only for business purposes and not for personal use. We shall neither be liable nor responsible for any actions or inactions of sellers nor any breach of conditions, representations or warranties by the sellers or manufacturers of the products or services and hereby expressly disclaim and any all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between you and the sellers or manufacturers of the products and services. We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed or displayed or transacted or the content (including product or pricing information and/or specifications) on the Platform. While we have taken precautions to avoid inaccuracies in content, this Platform, all content, information (including the price of products), software, products, services and related graphics are provided as is, without warranty of any kind. We do not implicitly or explicitly support or endorse the sale or purchase of any products or services on the Platform. At no time shall any right, title or interest in the products sold through or displayed on the Platform vest with Gramik nor shall Gramik have any obligations or liabilities in respect of any transactions on the Platform. To the extent permitted under law, Gramik shall not be responsible for any harm resulting from downloading or accessing any information or material, the quality of servers, products. We disclaim any responsibility for, and if you pay for access to one of our services you will not be entitled to a refund as a result of any inaccessibility that is caused by our maintenance on the servers or the technology that underlies our sites, failures of service providers (including telecommunications, hosting, and power providers), computer viruses, natural disasters or other destruction or damage of Our facilities, acts of nature, war, civil disturbance, or any other cause beyond our reasonable control. In addition, Gramik does not provide any warranty as to the content on the Platform. The Platform content is distributed on an "as is, as available" basis. Any material accessed, downloaded or otherwise obtained through our Platform is done at your discretion, competence, acceptance and risk, and you will be solely responsible for any potential damage to your computer system or loss of data that results from your download of any such material.
Gramik shall make best endeavors to ensure that the Platform and experience through it is error-free and secure, however, neither Gramik nor any of its partners, licensors or associates makes any warranty that:
• the Platform will meet your requirements;
• the Platform will be uninterrupted, timely, secure, or error free;
• the listings on the Platform will be accurate or reliable; and
• the quality of any products, Platform services, information, or other material that you purchase or obtain through the Platform will meet your expectations. To the extent permitted under law, neither Gramik nor its partners, licensors or associates shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if we have been advised of the possibility of such damages. 16. Indemnity and Release You shall indemnify and hold harmless Gramik, its subsidiaries, affiliates and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney’s fees, made by any third party or penalty imposed due to or arising out of your breach of these Conditions of Use, Terms or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party. You hereby expressly release Gramik and/or its subsidiaries, affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the vendors and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise. 17. Minors Use of Gramik. is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may use Gramik. only through a parent or guardian. 18. Sellers If you are a seller on Gramik, you hereby undertake to not sell, distribute, deliver, display for sale or store for sale, through Gramik, any commodity in the packaged
form unless the package complies in all respects with the provisions of the Legal Metrology Act, 2009 and the related rules; and all other laws applicable to the sale of your products. You further undertake to comply with the Legal Metrology Act, 2009 and the related rules and all other laws applicable to the sale of your products therein in spirit and form. 19. Other Businesses Parties other than Gramik and its affiliates operate stores, provide services, or sell product lines on Agent Gramik app. For example, businesses and individuals offer products via Marketplace. In addition, we may provide links to the websites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant or endorse the offerings of any of these businesses or individuals, or the content of their websites. Gramik does not assume any responsibility or liability for the actions, products, and content of any of these and any other third-parties. 20. Communication When you visit the Platform, you are communicating with us electronically. You will be required to provide a valid phone number while placing an order with us. We may communicate with you by e-mail, SMS, phone call or by posting notices on the Platform or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the Platform and/or your order placed on the Platform and it shall be deemed by your continued use of the Platform that you agree and consent to receive communication from us. Our communication to you can include but not be limited to the following:
i. notifications, messages, etc. for order placement, KYC submission and processing status;
ii. ‘Notify Me’ feature where you can click on a button if a particular product is unavailable. Once the same is back in stock, we send a notification / message in relation to the same; and
iii. an IVR based call post product delivery to confirm whether it has been delivered or not. 21. Losses
In no event will we be liable to you for any type of incidental, special, exemplary, punitive, remote, indirect or consequential damages, including, but not limited to, lost revenue, lost profits, replacement services, loss of technology, rights or services, loss of data, or interruption or loss of use of the services, whether arising under any theory of contract, tort, strict liability or otherwise even if we have been advised of the possibility of such damages. 22. Alteration of Service or Amendments to the Conditions We reserve the right to make changes to our Platform, policies, and these Conditions of Use at any time. You will be informed of such changes periodically. We reserve the right to block your access to the Platform in case you do not comply with these Conditions of Use. You will be subject to the policies and Conditions of Use in force at the time that you use the Platform or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition. 23. Credit Orders We have launched feature on our platform, which will enable users to view available credit, outstanding credit and overdue credit, so that users may make educated purchases of seller/manufactures’ products. Payments, in this regard may be made directly to seller/manufacturer. You understand that we are only acting as intermediaries for the provision of such information and therefore we cannot be made liable for any claim that you may have relating to such information. In the event you have such claim, you agree that you will pursue such claims directly with seller/manufacturer and not involve us in anyway. 24. Loyalty Programs/ Offers We may introduce loyalty programmes and other product or application related schemes and offers. If these Conditions of Use are inconsistent with the terms and conditions of such programmes, schemes and offers, these conditions of Use will prevail. Discount Vouchers/ Coupons
a. Eligibility of the coupon: You are entitled to the discount coupon for the orders placed on the Platform on such dates when the discount offer is running, subject to the order value reaching the minimum threshold mentioned on the Platform.
b. These coupons are non-transferable and non-redeemable for cash/any other mode and cannot be combined with any other coupons or any other offer or discounts or promotions offered by us.
c. Each coupon is identified by a unique code and you can redeem the coupon to get an upfront discount of such amount mentioned in the respective coupon whilst being bound by the conditions linked to the redemption of the coupon.
d. Each coupon will have the value; validity/expiry date, minimum order value, terms of use and other applicable terms mentioned.
e. To redeem the coupon code, you should type the coupon code into the promotional box in the booking field of the Platform and the relevant discount (subject to minimum order value being met) will be automatically deducted from the final price of the qualifying purchase. If you fail to enter the coupon code at the time of purchase as specified, the purchase will not be eligible for the discount. Discounts may not be claimed after confirmation of your order on the Platform.
f. TDS as applicable will be deducted as per the provisions of the Income Tax Act.
g. If a coupon is used and the order (in accordance with the cancellation policy) is then cancelled at a later stage by you, the coupon will no longer be valid.
h. Cancellation of orders with a coupon:
i. Cancellation before payment - when an order is cancelled by the er before the payment, the applied coupon will be reactivated with the same parameters (value, start date, end date)
ii. Cancellation after payment - when an order is cancelled through the admin portal / seller partially or fully, we will refund the amount paid by the er to the original payment method and expire the coupon value. We will create the equivalent value of the coupon with the same parameters.
i. We accept no responsibility for late, lost or misdirected communications. We assume no responsibility for any failure to receive a claim or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then we may modify, cancel, terminate or suspend the coupon.
j. We reserve the right to amend/discontinue/ withdraw the coupon and/or the discount program at any point of time without any reason and prior notice. 25. NBFC Credit We may introduce an embedded credit option through our NBFC partners, to provide B2B credit for purchases through our Platform. There are separate terms and conditions of NBFC credit option which will be available once you confirm your assent to avail this scheme via clicking of promotional banner or other promotional modes shared with you from time to time. If these Conditions of Use are inconsistent with the terms and conditions of the credit scheme, the terms and conditions of the credit partner will prevail. If you are interested in availing this facility of availing credit through the NBFC’s, you will need to confirm your assent at product page or via clicking promotional banners / proceeding ahead in the journey as shared with you in other communication mediums. Upon your confirmation, we will provide your information to the NBFC. By giving the aforesaid consent, you allow us to share your information including personal information available with us with the NBFC. We may also introduce a repayment facility on our Platform which can be utilised by the users availing this credit facility from our partner NBFCs to repay the relevant NBFCs. Please note that the use of this facility is an arrangement/agreement between you and the relevant NBFC. You will have no recourse against us at any point of time in relation to or in connection with this facility provided by us. In case of failure by you to repay the amount due to the relevant NBFC, amongst others, we reserve the right to block you from placing any orders on the Platform. 26. Third-Party Credit We enable users to avail credit directly from third-parties for purchases through our Platform and application. There are separate terms and conditions of third-party credit option which will be available once you confirm your assent to avail this scheme. If these Conditions of Use are inconsistent with the terms and conditions of a credit scheme, the terms and conditions will prevail. 27. Product Scanning We have introduced a reward programme whereby users may scan products to earn rewards. However, Gramik reserve the right, at its sole discretion, to change, modify,
add or remove portions of this document, at any time without any prior written notice to user. 28. Offers and Incentives We have introduced an offers section on our Platform which showcases different offers launched by us and / or associated brands. If a particular brand (including a brand forming part of the Gramik group or that of a third-party seller) does not honour the offers made, Gramik will not be liable for any non-compliance or non-credit of incentive/benefit or otherwise by such brand. We will only be responsible for the offers launched by us i.e., Gramik. We offer incentives, etc. in form of points which can be used for cash redemption or utilising against future orders. The limit of cash redemption per month may vary at the sole discretion of Gramik and you hereby agree to the same. Further, in some cases we may have to reverse points due to erroneous credit as a result of glitches / fraudulent activity on our Platform. We will block users from redeeming points on observing fraudulent / unfair / unusual activities. This can be on points scanning, points redemption, order placement through Platform, etc. We can also extend this blocking to the ERP or Taly system of Gramik and basis that disallow specific users from placing orders on our Platform for Gramik products. If these Conditions of Use are inconsistent with the terms and conditions of the particular offer or incentive, the terms and conditions of the particular offer or incentive will prevail. 29. Integration with Agriprojunction Ventures Private Limited (“Gramik”) We have launched feature of accepting through our Platform, payments due to be made by customers of Gramik to Gramik. Such payments will be transferred to Gramik directly from the customer’s account. No commission, fee, etc is charged by us in such transactions. The use of this feature is at the sole discretion of customer. Refunds are not applicable for such transactions from our side since no sale is done by us in such cases. Refund, if any, needs to be claimed directly from [Gramik]. Moreover, we cannot be held liable for any incorrect transfer on non-refund by any seller of this amount. 30. Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. 31. Waiver If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions. 32. Governing law and Jurisdiction These conditions are governed by and construed in accordance with the laws of India.
